What does
trademark registration mean?
A
trademark may consist of a name, logo or other distinctive element used to
distinguish the goods or services of one business from another. In Saudi
Arabia, trademarks are registered through the Saudi Authority for Intellectual
Property (SAIP). Registration is more than reserving a name; it creates a
stronger legal position for the owner within the goods and services covered by
the registration.
Who can apply?
According
to SAIP, the trademark registration service is available to individuals and
establishments. A company is therefore not required in every case. However,
choosing the correct owner from the beginning is important, especially when a
project is expected to operate through a different legal entity later.
Registration
steps
The
process starts by defining the mark and the goods or services on which it will
be used. The appropriate class is then selected, application data is prepared
and the filing is submitted electronically. The application is examined and may
be accepted, accepted subject to amendment, or refused. If accepted, the
publication fee is issued and the mark is published for 60 days. If publication
ends without an objection preventing registration, the final registration fee
becomes due and the certificate can then be issued.
Government fees
SAIP
currently lists SAR 1,000 for filing the application, SAR 500 for publication,
and SAR 5,000 for registration and issuance of the certificate. The basic
government total is therefore SAR 6,500 when all stages are completed. These
are government fees and do not include professional service fees.
Does paying the
filing fee guarantee acceptance?
No.
Payment places the application into the examination process; it does not
purchase an approval. A mark may be refused or an amendment may be requested
for reasons relating to the mark itself, earlier rights or examination
requirements. Any promise of 100% guaranteed acceptance before an official
decision should therefore be treated with caution.
How long does
registration take?
SAIP
currently displays a service execution time of 90 days, while the publication
stage itself lasts 60 days. Actual timing may vary if amendments are requested,
payments are delayed or an objection is filed during publication.
Selecting the
correct class
Trademark
protection is connected to classes of goods and services. A wrong class may
result in protection that does not match the actual business or may require
additional applications later. The class should be selected according to the
real activity and the goods or services offered.
Is an
exact-name search enough?
No. Exact
searching is useful but not sufficient. Earlier marks may be similar in
pronunciation, spelling or overall commercial impression. A sensible pre-filing
review should therefore go beyond checking only for an identical name.
